ELLSWORTH COUNTY COMMISSION MEETING
MINUTES
NOVEMBER 13, 2007
The Board of Ellsworth County Commissioners convened this 13th of November at the Ellsworth County Courthouse.

Chairman Rush called the meeting to order at 9:00 a.m.
Commissioner Kueser moved to approve the Agenda with additions. Commissioner Rush seconded the motion. Motion carried 3-0.
Commissioner Kueser moved to approve the Minutes of November 5, 2007. Commissioner Oller seconded the motion. Motion carried 3-0.
No one was present for the Public Forum.
Rick Nondorf, Road & Bridge Supervisor, reported the bid letting on the Dlabal Bridge is scheduled for November 14th and our estimated portion is $83,900. The Spring Creek Bridge that was to be bid next year has now been postponed until 2012. Mr. Nondorf discussed the new federal mandate that any bridge rated 3 tons and under is to be closed. He will further investigate this matter. They started on the roof on the shop building and he is working on a salary schedule as discussed earlier. All bridges in the county have to be inspected every two years and Mr. Nondorf presented a contract with Kirkham, Michael & Associates for that inspection at $44 per bridge. Commissioner Kueser moved to approve a contract with Kirkham, Michael & Associates for FAS and off-system bridge inspection for $9,196. Commissioner Oller seconded the motion. Motion carried 3-0. The State is now requiring an overhead tank spill policy on all tanks that hold 9,999 gallon or over and the policies have to be done by an engineering firm. Since the county has one 10,000-gallon tank, Mr. Nondorf would like to start working on the spill policy with Kirkham, Michael & Associates and presented a contract to that effect. The Commissioners agreed and signed the contract.
Ray Thomas sat in on the meeting and asked the Commissioners if the landfill could be opened on Saturday afternoon. The Commissioners will discuss his request with the landfill supervisor.
Doug McKinney, North Central Regional Planning Commission, asked the Commissioners to sign a letter to the Department of Commerce asking that they separate the bid solicitation process from one into a two or more. One would be the construction bid and the other bids would be for the SCADA system, telemetry stem and electrical and process control systems. There are contractors that have worked with the latter systems for a number of years and are familiar with those systems and by utilizing them, could save the project time and money. The Commissioners signed the letter.
Commissioner Kueser moved to approve Resolution 07R09, An Update Of A Resolution Licensing And Regulating Establishments In Unincorporated Areas of Ellsworth County, Which Sell Or Serve Cereal Malt Beverages. Commissioner Rush seconded the motion. Motion carried 3-0.
County Clerk, Jan Andrews, updated the Commissioners on the following items: The FEMA maps are in the Appraiser's office and they are checking the data for errors; and the auditors suggested a line item in the general fund to set aside funding for a new landfill pit. No bids were received on the old generator at the jail. After talking with the Sheriff and finding out that the City of Kanopolis had inquired about it, it was decided that if the City would like to have it they would donate it to them. If not, it would be discussed again. The Clerk was given permission to update the postage meter.
Commissioner Kueser moved to approve Refunding Warrant 118 in the amount of $3,613.92. Commissioner Oller seconded the motion. Motion carried 3-0.
Commissioner Kueser, upon the recommendation of the County Attorney, moved to approve the Partial Assignment of Road Maintenance Agreement between Smoky Hills Wind Far, LLC and Smoky Hills Wind Project II, LLC. Commissioner Rush seconded the motion. Motion carried 3-0.
Chairman Rush adjourned the meeting at 11:45 p.m.
